Se declaró la nulidad de todo lo actuado en la tutela promovida por la ciudadana de la referencia contra la EPS Coomeva, a partir del auto proferido por el Juzgado respectivo, visible a folio 33 del expediente.
Lo anterior, porque se aplicó el Art. 1, numeral 1, inciso 3, del Decreto 1382 de 12 de junio de 2000 que, como ya se dijo, no resulta aplicable por ser contrario a la Carta Política.
En consecuencia, se ordenó remitir el expediente al Tribunal Superior de Pasto, para que realice el trámite correspondiente en esta tutela conforme a la Ley.

- Primero. de Familia de Pasto, visible a folio 33 del expediente.
- Segundo. Remitase el expediente por Secretaria al Tribunal Superior de Pasto, para que, de manera inmediata le imprima a esta accion de tutela el tramite que corresponda conforme a la Ley.
